TERMS AND CONDITIONS OF SALE

 

Preamble

JEANNE LANVIN creates, designs and distributes worldwide women’s, men’s and children’s luxury ready-to-wear items and fashion accessories, shoes, leather goods, luxury jewelry for women, children and men.

These general terms and conditions of sale (hereinafter “General Terms of Sale”)  are those of JEANNE LANVIN, société anonyme à conseil d’administration, with a share capital of 16,297,330, euros, whose registered office is located at 22, rue du Faubourg Saint-Honoré, 75008 Paris, France, registered in the Paris Trade and Companies Register under number 612 048 629; VAT FR FR16612048629.

 

ARTICLE 1 – SCOPE

These General Terms of Sale apply, unconditionally and unreservedly to all sales entered into by JEANNE LANVIN, the (hereinafter “JEANNE LANVIN” or the “Vendor”), to consumers and non-professional buyers, the (hereinafter the “Customers or the Customer”), wishing to purchase the products offered for sale by the Vendor, the (hereinafter the “Product” or the “Products”) on the www.lanvin.com website (hereinafter the “Site”).

The Products are intended to be sold exclusively to end buyers who are natural or legal persons, acting exclusively for their personal needs and not directly related to a commercial activity, excluding any resellers or intermediaries acting on behalf of resellers. Therefore, the Customer affirms that he/she is acting as a consumer and that he/she does not intend to resell the Products for commercial purposes. He/she also certifies that he/she has the legal capacity to enter into the commitments provided in these General Terms of Sale.

 
These include the terms of ordering, payment, delivery, and of managing any returns of Products ordered by Customers.
The General Terms of Sale apply and exclude all other terms, in particular those which apply to sales in shops or through other distribution and marketing channels.


They may be perused at any time on the Site and take precedence, if necessary, over any other version or another contradictory document.

Since these General Terms and Conditions of Sale may be subject to further modification, the version applicable to the Customer’s purchase shall be those in force on the website on the date the order is placed.

 

Changes to these General Terms of Sale are enforceable on users of the  Site from the date they are put online and do not apply to transactions entered into previously. For this reason, the Vendor asks the Customer to read the General Terms of Sale carefully before placing each order. Any order implies prior perusal and acceptance of the General Terms of Sale by ticking the box “ I hereby Agree and Consent to LANVIN’s Terms and Conditions of Sale and Privacy Policy.”. They will be available for viewing before and when the Customer is asked to confirm them.

ARTICLE 2 – THE PRODUCTS OFFERED FOR SALE

The Products offered for sale on the www.lanvin.com website Site are those that are shown on the Site on the day the Customer visits the Site.

The key characteristics of the Products and in particular the specifications, illustrations, and indications of dimensions or capacity of the Products, are presented on the Site.

 
The Customer is responsible for taking note of these before placing an order.
The choice and purchase of a Product is the Customer’s sole responsibility.
The photographs on the Site are presented for illustrative purposes.
The Customer is required to refer to the description of each product to learn about its properties, key characteristics, and delivery lead times.
The contractual information presented in French and English must be confirmed when the Customer confirms the order at the latest.

 

The Products presented on the Site are offered for sale in the following countries: Andorra, Austria, Belgium, Bulgaria, Canada, Croatia, Cyrpus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, United Arab Emirates and the United Kingdom.

Should an order be to a country other than the countries listed above, the Customer is the importer of the Product(s) concerned.


For all Products shipped to the United Kingdom, United Arab Emirates and Canada, the price of the Product will be indicated on the invoice as well as any customs duties or other local taxes, import duties, or state taxes that may be payable. They will be payable by the Customer.

 

ARTICLE 3 – VALIDITY PERIOD OF THE PRODUCT OFFERS

 

The Product offers and prices are valid for as long as they are mentioned on the Site. Product availability information is provided to the Customer on the day of the order, either by Customer Service or on the information page of the Site describing the availability of the Products.

Should, exceptionally, in spite of vigilance on the part of JEANNE LANVIN the Products ordered and paid for, be no longer available, the Customer Service will contact the Customer by any manner (phone or email) as soon as possible to inform them of this and to make a full refund of the amounts paid by the Customer. JEANNE LANVIN shall not be liable in the event of unavailability of a Product on the Site. The Vendor reserves the right to withdraw Products from sale at any time and without notice. Stocks may be limited during commercial transactions such as sales.

Confirmation of the order by the Customer is deemed to be unconditional and unreserved acceptance of the General Terms of Sale.

The Customer acknowledges having the capacity required to contract and purchase the Products offered on the Site.

 

ARTICLE 5 – ORDERS

Orders placed on the Site are subject to strict compliance with the procedures described below.

Special orders cannot be placed on the Site; JEANNE LANVIN invites its Customers wishing to order special Products to visit a boutique to place their order.

5-1 Customer’s selection of Products

1. On the Site, fill the virtual cart by clicking on the “Add to cart” button and indicating the selected Products, size and desired quantities you wish to order; said Products are added to the Customer’s “Shopping Bag”.

The Customer may freely modify his/her “Shopping Bag”, delete an initially selected Product, modify the quantities ordered or alternatively add a Product by clicking on the corresponding elements within the “Shopping Bag”.

The Product shipment date will then be indicated.

2. Check the virtual cart and, if necessary, change its contents.

3. Click on the “Proceed to checkout” button.

5-2 Identification

1.Identify yourself on the Website

  • either by creating an account on the Website by clicking on “Register” and completing a form, some of whose fields are mandatory for your order to be taken into account ;
  • or if you already have a customer account, by logging in to the website by entering your email address and password and clicking on “Log in”.

The Customer’s login details and password are intended to be used only by the Customer; therefore each Customer agrees to keep them secure and to not communicate them to third parties. The Customer agrees to immediately inform JEANNE LANVIN in case of loss, theft or any fraudulent use of his/her customer account.

5-3 Validation of the order

1. Fill out the delivery information (full identity, email address, phone number, delivery contact details). Enter the billing address if it is different from the shipping address. Agree to LANVIN’s Terms and Conditions of Sale and Privacy Policy by clicking on the box. Then, choose you delivery method.

2. On completing the order process, the Customer is asked to choose their payment method by bank card, by PayPal account, by Klarna, by Sofort, by Bancontact or by Ideal. For payment by bank card, the Customer must enter the details of the bank card used (holder name, card number, expiration, CVV).

3. They will then be asked to click on the “Place order” icon. When clicking on this button, the Customer will be redirected to the payment service provider, and will make payment according to the desired terms (Carte Bleue, Visa, MasterCard, and American Express only) - please refer to the Payment Terms article for more information.

 5-4 Validation of the order

Registration of an order on the Site is made when the Customer accepts the General Terms of Sale by checking the box provided for this purpose and confirms their order. This confirmation implies acceptance of all the General Terms of Sale as well as that of the Terms of Use of Site.

 An acknowledgement of receipt of the order is sent to the Customer by email. In accordance with the provisions of Article 1126 of the French Civil Code, the Customer accepts the use of electronic mail for JEANNE LANVIN’s confirmation of the order content.

The acknowledgement of receipt shall include the order number, the total amount of the order, information relating to cost and delivery time, defining features quantity and price of the Products purchased.

After receipt of the confirmation email, the order can neither be modified nor canceled, unless the right of withdrawal is exercised or in the event of force majeure.

 

Orders shipping to Canada: For orders above 2 500 USD additional information will be required. A Tax ID or Social Security Number (SSN) is required to clear the order from the customs and is therefore mandatory. Should the Customer refuse to provide this information to the Vendor or to the carrier UPS, the order will be canceled. A month after your last interaction with JEANNE LANVIN, this data will be removed from all databases and email accounts by our teams.

 

Any order placed, confirmed by the Customer and confirmed by the Vendor, according to the above-described terms and conditions, on the Site is a contract concluded remotely between the Customer and the Vendor.

The Customer will be notified by email as soon as their order is deposited with the partner-carrier and they will be able to track the shipment of their order on the UPS website using the shipping number indicated in the email.

Please note that orders placed during a Sale period may expect a delay in fulfilment.

The Vendor does not wish to sell the Products on the Site to professionals, but only to consumers or non-professionals for their personal needs.

5-5 Refusal of an order

Purchases made on the Site shall be reserved for Customers for their own use (or gifts) and not for resale. In accordance with the provisions of Article L. 121-11 of the French Consumer Code, JEANNE LANVIN shall be entitled to refuse any unusual order exceeding the number of authorized Products, namely:

  • eight (8) Items per order; and/or
  • two (2) identical Items ordered within a period of thirty (30) calendar days, of all colors and sizes combined.

JEANNE LANVIN will also be entitled to refuse any order: (i) made by a Customer with whom there is a dispute relating to the payment or delivery of a previous order; or (ii) not in accordance with these General Terms of Sale.

JEANNE LANVIN will notify the Customer if it finds that the order does not comply with these General Terms of Sale, either directly on the Site or by telephone or email. If the Customer fails to correct any error or noncompliance with these General Terms of Sale contained in his/her order with JEANNE LANVIN within a period of five (5) calendar days following the notification mentioned just before, JEANNE LANVIN reserves the right to cancel the order altogether, as well as the payment.

5-6 Proof of order

It is expressly agreed between JEANNE LANVIN and the Customer that emails are admissible between the parties, as well as the automatic recording systems used by Customer Service or on the Site, in particular as regards the nature and date of the order. The data recorded in the Vendor’s computer system are proof of all the transactions with the Customer.

Invoices are archived on a reliable and durable medium to ensure they are faithful and durable copies. 

In addition, pursuant to Article L. 213-1 of the French Consumer Code, JEANNE LANVIN shall retain the information relating to any order for an amount equal to or greater than one hundred and twenty (120) euros for a period of ten (10) years and shall make it available to the Customer upon request addressed by the latter to: customercare@lanvin.com or to JEANNE LANVIN – Service Relation Client – 22, rue du Faubourg Saint-Honoré –  75008 Paris (France). However, it is recommended that the Customer also keeps a copy (in electronic format and/or on paper) of the details relating to his/her order for any orders placed on the Site.

 

ARTICLE 6 – PRICES

The Products are supplied at the prices in force appearing on the Site at the time the order is recorded by the Vendor, subject to the availability of the Products ordered at that time. Prices are expressed in euros and include VAT for sales in European Union countries, in British pounds for sales in the United Kingdom, in AED for the United Arab Emirates and in Canadian dollars for sales in Canada.
The prices take into account any reductions granted by the Vendor on the Site.

It is specified that the tax refund services is not available for remote purchases of JEANNE LANVIN Products.

The Vendor reserves the right to offer promotional codes. These promotional codes may only be issued by the Vendor and will not be applicable to the price of Products already subject to other promotions (seasonal sales, batch sales, sales with free products or services, price reductions, etc.). The Vendor may not be held liable for any promotional codes disclosed on the forums other than those issued by it and to which it has not consented.

 
These prices are firm and not revisable during their validity period, as indicated on the Site, with the Vendor reserving the right, outside of this validity period, to change the prices at any time. They do not include the processing, shipping, transportation and delivery costs, which are charged in addition, according to the terms indicated on the Site and calculated prior to placing the order. Standard shipping method fees are the following : 
- Deliveries to France and European Union: free 
- Deliveries to the UK: 20£ 
- Deliveries to Canada: CA$20 
- Deliveries to UAE: 80AED 

If the Customer requests a faster shipping method or one that is more expensive than standard shipping, the additional delivery costs, as they appear when the Customer confirms the order, shall be entirely at the Customer’s expense.
The payment requested from the Customer is the total amount of the purchase, including these costs. The amount of these charges shall be communicated to the Customer prior to the validation step of his/her order.

All Products have an identification label affixed to them with a single-use seal.

In accordance with the provisions of Article L. 221-11 of the French Consumer Code, the Customer will receive written confirmation of the amount paid, detailing the price per Products and shipping costs charged for each of the Products, at the latest upon delivery.

 

ARTICLE 7 – PAYMENT TERMS

The provisions of Article 1341 of the French Civil Code are not applicable to distance sales concluded by JEANNE LANVIN.

In the event that, for any reason whatsoever (objection, refusal on the part of the credit card issuer, etc.), the debit of the amount payable by the Customer proves to be impossible, the sale shall be immediately cancelled and the Vendor shall immediately stop processing the order.

For payment of the price of the Products and the costs associated with shipment and delivery, the Customer may follow the procedures indicated in the order form.

The price is payable in cash, in full on the day the order is shipped to the customer by the Vendor by secure payment, according to the following conditions:

  • by bank card: Bank Card, Visa, MasterCard, American Express, other bank cards;
  • by PayPal account
  • by Klarna
  • by Sofort
  • by Bancontact
  • by Ideal

If payment is made by credit/debit card, financial information (e.g. the credit/debit card number or expiration date) will be transferred, using a cryptographic protocol to Paypal payments or other banks that provide services related to remote electronic payment, without any third parties having access to them under any circumstances. The Vendor will never become aware of financial information. It will liaise with Paypal payments for the procedures related to your purchase or to issue refunds in the event of any return of the Products in accordance with the right of withdrawal, or if it is necessary to prevent or report the occurrence of fraud on the Site to the competent authorities.

The Vendor uses a third-party secure payment system, Paypal payments. Processing of payments or any credits arising from the service will be governed by the terms and privacy policy of Paypal payments, the Vendor’s partner, and the terms of the Customer’s credit card issuer. The Vendor disclaims all liability in the event of an error due to the payment system.

 The order shall be shipped only after verification of the payment method, receipt of the authorization to debit the Customer’s credit card or confirmation from Paypal, verification of the conformity of the order with these General Terms of Sale and the availability of the Products.

ARTICLE 8 - PRODUCT DELIVERY

The Products ordered by the Customer will be delivered in Metropolitan France (and in the following countries: Andorra, Austria, Belgium, Bulgaria, Canada, Croatia, Cyrpus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, United Arab Emirates and the United Kingdom) within 3 to 7 days from the order shipment date.


It is not possible to place an order for any delivery address located outside the Delivery Zone. For primarily security reasons, JEANNE LANVIN will not process any order whose delivery or billing address is a post office box.

The Customer shall also have the option of having the Products delivered to another individual located within the Delivery Zone, for example, when the order is a gift.

Unless one or more Products are unavailable, the Products ordered will be delivered together.

Once payment of the amount of the order has been registered, the Products will be delivered to the delivery address indicated by the Customer during the ordering process. For this reason, the latter undertakes to have communicated the correct delivery address to JEANNE LANVIN. The Vendor shall make every effort to deliver the Products ordered by the Customer within the above-stated times. However, these periods are provided as an indication only. If the Products ordered have not been delivered within 5 days of the indicative delivery date, except in cases of force majeure such as a pandemic and lockdown, for any cause other than force majeure or due to the Customer’s action, the sale may be canceled at the Customer’s written request under the conditions laid down in Articles L. 216-6, L. 216-7 and L241-4 of the Consumer Code. The amounts paid by the Customer will then be returned within fourteen days of the contract termination date, with no compensation or deduction retained.


If the delivered Product is defective, the Vendor undertakes to rectify the problem or refund the Customer, as described in Article 11 - “Statutory Warranties ”.


The Vendor bears the risks of transportation and is responsible for refunding the Customer in the event of damage caused during transportation.

 

ARTICLE 9 – RETENTION OF TITLE

JEANNE LANVIN shall retain ownership of the Products until such time as JEANNE LANVIN has received payment in full. However, the Customer assumes the risks (in particular those related to loss, theft or damage) concerning the Products delivered from the moment they are delivered to the address indicated at the time of placing the order. The transfer of the risks of loss or deterioration relating thereto will only be made when the Customer or a designated third party takes possession of the Products, according to Article L. 216-2 of the French Consumer Code. The Products, therefore, travail at the Vendor’s own risk.

 

ARTICLE 10 – RIGHT OF WITHDRAWAL

The aim of the Site is to guarantee the Customer's entire satisfaction. However, if for any reason the Customer is not satisfied with their order, they may, without penalty, subject to the terms set out in the General Terms of Sale, exercise their right of withdrawal within fourteen (14) days from the date on which they have received the Products purchased on  the Site. The Products that the Customer wishes to return must, within fourteen (14) days of the date on which they have exercised their right of withdrawal, be returned by the carrier of their choice or consign them to the UPS carrier according to the terms specified below. The Products may thus be returned by having the package sent by the carrier indicated by the supplier (UPS), provided that the Return Form that the Customer will find online in the My Account section or by contacting Customer Care. However, the chosen item may not be exchanged for a different one.

Returns of orders from December 2023 will be accepted until January 8th 2024.


10.1 Terms for exercising the right of withdrawal:

The terms for exercising the right of withdrawal are as follows:

  1. The Customer is invited to carefully fill in the return request in his customer area, in the framework where he registered, within 14 days following the date of receipt of his order. If the Customer has placed the order as a guest, or if he encounters difficulties, the return request can be made directly to our Customer Service;
  2. The Products must not have been worn, used, modified, washed or damaged and, in all cases, comply with the conditions stated in the section on the Conformity checks below;
  3. The refund label must still be attached to the Product with the single-use seal;
  4. The Products must be returned in their entirety, unused and in their original packaging;
  5. The returned Products must be consigned to the carrier within fourteen (14) days of the date on which your right of withdrawal is exercised.
  6. Please note that swimsuits, tights and masks cannot be returned at any time.

If the Customer has complied with all the requirements, the Vendor will refund the price of the Products purchased and returned.

If the Customer chooses to use UPS, the following return costs will be applied: 
- Returns from France and the European Union: €10 
- Returns from the UK: £20 
- Returns from Canada: CA$20 
- Returns from the United Arab Emirates: 80AED 
Delivery and return costs are not refundable. Return shipping costs will be deducted from the refund you receive. The amount of the return costs is indicated under the heading “Adjustment fee” in the proof of refund (credit memo). Return shipping fees are at the Client's own expenses. Should the Customer chooses to use a carrier different from that proposed by www.lanvin.com, the Customer will have to pay the return costs directly to the carrier they have chosen.

Returns may be shipped by the UPS carrier specified by Vendor.

For any return the customer must either create a return in "My Account" section if registered as a user, or must contact the customer care which will send them a return voucher, a pre-printed label to affix to the package.

This process will allow the Vendor to pay the return costs to the carrier directly and to check at any time where the package is located. The Customer will contact UPS to arrange the return of the Products. If for the return of the Products, the Customer decides to use a different carrier from that indicated by www.lanvin.com, they will personally pay the return costs and they will bear responsibility for loss or damage of the Products during the carriage.
The Customer will be contacted again if their return cannot be accepted as it does not comply with the conditions stated in paragraphs a) and e) of Section 10.1 above. The Customer may choose to have the Products they have purchased sent back to them. In the absence of such a request, the Vendor may keep the Products, in addition to the amounts already paid for their purchase.

10.2 Conformity checks
The Products must be returned in their original condition, unused, in perfect condition, with all protective packaging, labels, and adhesives affixed to them (if applicable), including all accessories and documents. The Vendor reserves the right to refuse any Product return that shows signs of wear, or that has been used or modified compared to its original condition in any way, or alternatively, reduce the refund amount or the value of the exchange, as the case may be.
For example, the Vendor may choose to grant a partial refund in the following cases:

  • the product(s) have been used, worn, damaged, or washed;
  • the single-use sealed identification label is not attached to the product(s) or has not been returned. The Customer should note that the identification label is an integral part of each product; and/or
  • the Customer has not returned a packaging item that is an integral part of a product (e.g. the dust bag or storage bag).

The Customer will be informed if the Vendor decides to reduce the amount of the refund for this reason. In this case, the Customer may (rather than obtain a partial refund from the Vendor) choose to have the Products returned to them at their expense. If the Customer refuses this delivery, the Vendor reserves the right to keep the Products and the amount specified as a partial refund due to the loss of value of the returned Products.

10.3 Refund time limits and terms:
After receipt and verification by the Vendor of compliance with the requirements, the Customer will receive an email confirming acceptance of the return of the Products. Regardless of the payment method used (credit/debit card), the refund is activated by the Vendor as soon as possible, no later than fourteen (14) days after the Products are delivered to the UPS carrier or, in the case of another carrier, on receipt by the Vendor of proof of shipment of the Products, provided that exercising this right meets all the conditions set out in the General Conditions of Sale.
The actual time needed to re-credit or refund amounts depends on the payment method used:

  • credit/debit card purchase: the refund time depends on the bank that issued the credit/debit card. The Vendor recalls that the date of the new credit (which is deemed to be the refund) will be the same as the debit date, as a result of which the Customer will not suffer any bank interest penalty;
  • purchase via PayPal: the refund on the customer's PayPal account will be visible immediately. The actual refund on the credit card of the Customer’s PayPal account depends on the credit card company;

If it is a gift, a refund of the amount will be made to the person who made the payment.

10.4 Product labels:
All Products offered for sale by the Vendor have a label fastened by a single-use seal. The Customer is requested to try the Products without removing the label or the corresponding seal since returned Products will not be accepted if they are missing.

 

ARTICLE 11 – STATUTORY WARRANTIES

The Vendor shall be liable for non-conformity of the Products with the contract under the conditions of Article L. 217-4 and following of the French Consumer Code and for hidden defects of the Product sold under the conditions laid down in Articles 1641 and following of the French Civil Code.

11.1 Statutory warranty of conformity

JEANNE LANVIN will deliver to the Customer a Product that conforms to the contract and is free of defects in conformity at the time of delivery of the said Product, in the sense that the Product shall be fit for the usual use expected of a similar good and that it will have the features presented during the sale. JEANNE LANVIN shall also be responsible for non-conformity resulting from the packaging, assembly instructions or installation where the contract made these its responsibility or where they have been carried out under its responsibility.

 When acting on the basis of the statutory conformity warranty, the Customer:

 

  1. has a two-year (2) period from delivery of the good to act;
  2. is exempted from reporting proof of the existence of the non-conformity of the Product for twenty-four (24) months following delivery of the Product because any non-conformity which becomes apparent within twenty-four (24) months of delivery shall be presumed to have existed at the time of delivery, unless proven otherwise.

The Customer may then choose to repair or replace the Product, unless one of these choices results in a manifestly disproportionate cost for JEANNE LANVIN, taking into account the value of the Product or the importance of the defect. If the repair or replacement of the Product is unavailable, the Customer may be refunded the price paid and return the Product or keep the Product and be refunded a portion of the price, unless the non-conformity is minor.

 

In the event of a conformity defect of a delivered Product, the Customer may return the Product with the conformity defect to the Vendor, in its original condition, which must have the original labels and the original packaging and the delivery note, specifying in advance to the Vendor the reasons for the return by contacting the Customer Service.

Failing this, the Vendor will neither repair nor refund the defective Product returned.

Should the return of the defective Product be well-founded, the Vendor will repair or refund the defective Product and the delivery costs, excluding any other compensation.

With the exception of the above cases, no Product exchange or repair is permitted.

11.2 Statutory warranty against hidden defects

JEANNE LANVIN will provide the Customer with a Product free of hidden defects that would make it unfit for the use for which it is intended, or that would diminish its use to such extent that the Customer would not have acquired it, or would have accepted to pay only a lower price, if he/she had known of such defect.

The Customer may decide to invoke the warranty against hidden defects of the Product sold within the meaning of Article 1641 of the French Civil Code and in this case, he/she can choose between cancellation of the sale or a reduction of the selling price in accordance with Article 1644 of the French Civil Code.

This warranty will only apply if the Customer makes the request within two (2) years of the discovery of the defect according to the Article 1648 of the French Civil Code.

In the event of a hidden defect, it will be up to the Customer to prove that it fulfills the conditions of the warranty.

The statutory warranties apply irrespective of the commercial warranty which may be granted. 

ARTICLE 12 - INTELLECTUAL PROPERTY 

Any intellectual property right pertaining to any JEANNE LANVIN product or element (including JEANNE LANVIN items), such as trademarks, illustrations, photos, images, designs and logos, whether registered or not, is and will remain the exclusive property of JEANNE LANVIN.

The content of the  Site, in particular, the textual, visual, graphic elements contained therein, in particular graphics, images, characters and any other element of the Site (“Content”), belongs to the Vendor and its partners and is protected by French and international intellectual property laws.
Lanvin’s trademark, the Site and its Content may not be modified, reproduced, represented, incorporated in a derivative work or otherwise, on any medium. Any total or partial reproduction, downloading, modification or use of Lanvin’s trademarks, illustrations, images, photos, logos and designs, for any reason and on any medium whatsoever, without the express prior written consent of JEANNE LANVIN, is strictly prohibited and may constitute an offense of infringement. 

No provision of the General Terms of Sale grants the Customer rights to the  Site.

 Likewise, the following are strictly prohibited without the express prior written consent of JEANNE LANVIN:

  • the creation of hypertext links to any of the pages or components of the Site; and
  • any use not conforming to this Site's license to use it and, in particular, use of any of its components (items presented, descriptions, prices, data, software, graphics, images, texts, photographs, tools, etc.) for sale or any other direct or indirect commercial use.

 

ARTICLE 13 – PERSONAL DATA

When the Customer navigates on the Site, creates an account and/or places an order, the Vendor acts in its capacity as the data controller of the personal data communicated by the Customer. For more information on how Lanvin collects and processes the Customer’s personal data as well as the rights the Customer has, they may peruse the Privacy Policy.

 

ARTICLE 14 - INFORMATION ON THE PRODUCTS – LIMITATION OF LIABILITY - FORCE MAJEURE

Information on all Products offered for distance selling shall be made available in all JEANNE LANVIN boutiques, on the Site or via Customer Service.

The photographs, graphics and descriptions of the Items offered for sale are only indicative and do not bind JEANNE LANVIN. Customers can obtain additional information by contacting Customer Service or at JEANNE LANVIN boutiques. While every effort is made to ensure that the color and pattern of the Products pictured on the Site accurately reflect the original Products, variations may occur, in particular due to technical limitations in the color rendering of your computer equipment. Consequently, JEANNE LANVIN cannot be held liable for non-substantial errors or inaccuracies in the photographs or graphic representations of the Products appearing on the Site.

In no event shall JEANNE LANVIN be liable for any damage that does not result from a breach by JEANNE LANVIN of one of its obligations or in the event of the occurrence of a fortuitous event or force majeure within the meaning of Article 1218 of the French Civil Code that would prevent or delay its performance.

JEANNE LANVIN will inform the Customer of any such fortuitous event or force majeure within seven (7) days of its occurrence.

In the event that this suspension of the performance of JEANNE LANVIN's obligations continues beyond a period of fifteen (15) days, the Customer will then have the option of cancelling the order in progress and the Vendor shall refund him/her as soon as possible.

 

 ARTICLE 15 - THE CUSTOMER'S ACCEPTANCE

By placing an order on the Site, the Customer is deemed to adhere to and accept in full the General Terms of Sale and the obligation to pay for the Products ordered. The Customer expressly recognizes the foregoing and waives, in particular, the right to rely on any contradictory document, which would, in any event, be unenforceable on the Vendor.

 

ARTICLE 16 – NON-WAIVER   

The fact that JEANNE LANVIN refrains from demanding at any given time the performance of any of the provisions of these General Terms of Sale may not be interpreted as a waiver of its right to raise subsequently said complete or partial non-performance.

 

ARTICLE 17 – VALIDITY OF THE GENERAL TERMS AND CONDITIONS OF SALE

If any of the provisions of these General Terms of Sale shall be declared null and void in whole or in part, the other provisions and the other rights and obligations arising from these General Terms of Sale shall remain unchanged and shall remain applicable.

 

ARTICLE 18 - APPLICABLE LAW - LANGUAGE

The General Terms of Sale and the operations arising therefrom shall be subject to French law, unless otherwise required by Regulation (EC) No 593/2008 of 17 June 2008 on the law applicable to contractual obligations (Rome I).

They are written in French. If they are translated into one or more other languages, only the French text would be considered authentic in the event of a dispute.

ARTICLE 19 - DISPUTES

In the event of any difficulty arising from the ordering or delivery of the Products and before any legal action is taken, the Customer shall have the opportunity to seek an amicable solution with JEANNE LANVIN and to have recourse to the CMAP – Centre de Médiation et d’Arbitrage de Paris –, a consumer mediator to which JEANNE LANVIN subscribes.

To submit a dispute to the mediator, the Customer may complete the form on the CMAP website: www.cmap.fr “You Are: a Consumer” tab, send his/her request by regular or registered mail to CMAP Médiation Consommation, 39 avenue Franklin D. Roosevelt, 75008 PARIS, or send an email to consommation@cmap.fr. Whatever the means used to contact the CMAP, the Customer’s request must contain the following elements to be processed quickly: its postal address, email address and telephone number, as well as the full name and address of JEANNE LANVIN, a brief statement of the facts, and proof of the steps taken by the Customer with JEANNE LANVIN prior to referring the matter to the CMAP.

 

In addition, the European Commission has set up an online dispute resolution platform to facilitate the out-of-court resolution of online disputes between consumers and professionals in the European Union. This platform can be accessed via the following link: https://webgate.ec.europa.eu/odr/.

The Consumer remains free to accept or refuse mediation and, in the event of recourse to mediation, each party is free to accept or reject the solution proposed by the mediator. In the absence of an amicable solution or recourse to mediation, all disputes arising from these General Terms of Sale shall be submitted to the competent court in accordance with the rules enacted by the French Code of Civil Procedure and the Consumer Code.
